The Registration Act, 1908 is most important legislation of the Land related laws. First time this act is introduce in 1908 and after that three times it was amended. Registration Act,1908 which specify the list of documents which registration is compulsory such documents contain in Section 17 (1) of the Registration Act, 1908. There are seven clauses of the said section which explain the documents which are compulsorily registered under said act those are :-
a) Instrument of Gift of Immovable Property. ( Sec.122 of Transfer of Property Act, 1882)
b) Other Non- Testamentary Instrument which purport or operate to create, assign, declare, limit or extinguish whether in present or future any right title or interest i.e. vested or contingent and Rs. 100 more the value of immovable property.
c) Non- Testamentary instrument which acknowledged the receipt or payment of any consideration on account of create, assign, declare of any such title right or interest.( Consideration)
d) Lease of immovable property which include year to year lease, lease more than one year and yearly rent reserve. Lease which explain under Sec.105 of Transfer of Property Act, 1882. In certain cases lease instrument is exempt from registration.
e) Any Non- Testamentary Instrument which transfer or assign any court order or any decree or reward and such decree, order or reward which purport or create, assign, declare, limit or extinguish whether in present or future any right title or interest i.e. Vested or contingent and Rs. 100 more the value of immovable property.
f) An authority to adopt a son, not conferred by a will which mean the will is silent on that topic and this will executed on or after 1st January. 1872.
g) any document which are contain the contract to transfer of any immovable property for consideration and this instrument is made on or after the commencement of the Registration and Other Related Laws (Amendment) Act, 2001.
The Registration of above seven instrument are compulsory under Section 17 (1) of the Registration Act, 1908.
Here Non- Testamentary Instrument means other than Will.
